What is flight overbooking?
Overbooking, practiced by airlines, is a legal practice in many countries, including those in Europe. It allows airlines to maximize revenue per available seat by selling more tickets than there are actual seats on the plane, based on the assumption that some passengers won’t show up at the airport. While this practice may seem controversial—especially when all passengers do show up for boarding—it helps airlines keep ticket prices lower for everyone.
However, there are regulations that airlines must follow to manage overbooking fairly and provide adequate compensation to passengers affected by this practice. For example, in the European Union, Regulation EC 261/2004 sets out the rights of air passengers and provides for refunds and compensation for those denied boarding due to overbooking or other travel disruptions such as cancelled flights or delayed flights.
How is overbooking resolved?
First of all, airlines ask if there are any volunteers willing to give up their seat on that flight in exchange for incentives such as vouchers, flight credits, or free upgrades. This is the preferred solution because it often helps resolve the situation quickly and smoothly.
If there are not enough volunteers, the airline must involuntarily deny boarding to selected passengers. This process follows specific criteria set by regulations, which typically include factors such as check-in order, travel class, frequent flyer status, and other variables. It’s important to note that minors are not separated from their parents (at least one guardian must travel with them), and usually—but not necessarily—families or groups under the same booking are not split. However, procedures may vary between airlines.
Once the passengers to be denied boarding are identified, they are provided with assistance and appropriate compensation as required by law, as described in the next section.
Passenger rights in case of overbooking
According to European regulations, passengers who are denied boarding (voluntarily or involuntarily) due to flight overbooking are entitled to:
1. Ticket refund or alternative flight
In the event of denied boarding due to overbooking, the passenger may choose to receive a refund for the ticket price or be rebooked on an alternative flight offered by the airline.
2. Ground assistance
The airline is required to provide immediate assistance, including meals and refreshments, accommodation, and transportation if necessary, as well as the option to make free phone calls.
If the airline does not directly provide these services, the passenger is entitled to a reimbursement of any additional expenses (direct and resulting from the overbooking) that were paid in advance.
3. Compensation
Also referred to as “financial compensation” or “damages,” this is intended to compensate the passenger for the inconvenience caused by denied boarding due to overbooking. The amount of compensation is based on the route (intra-EU or international) and the distance traveled, and may range from a minimum of €250 to a maximum of €600, as follows:
- €250 for all flights of 1,500 km or less
- €400 for all intra-EU flights over 1,500 km and for all other flights between 1,500 and 3,500 km
- €600 for all flights over 3,500 km
The airline may reduce the compensation by 50% if the passenger is rebooked on an alternative flight that arrives, compared to the original scheduled time, within:
- 2 hours for flights of 1,500 km or less
- 3 hours for intra-EU flights over 1,500 km and for international flights between 1,500 and 3,500 km
- 4 hours for international flights over 3,500 km


How to request a refund and compensation for overbooking
To request compensation and reimbursement for a flight affected by overbooking, you need to follow these simple steps:
