Ticket refund (reimbursement)
Applies when you are not flying: due to cancellation (if you refuse rerouting) or denied boarding (if you refuse the proposed alternative). It includes taxes/extras paid and, in some cases, vouchers only if you accept them voluntarily (you are not obligated). The reimbursement is not conditional on the responsibility of the company: it matters that the service has not been provided.
Lump sum compensation
This is the compensation provided for by EC 261/2004 or UK 261 in case of delay on arrival ≥ 3 hours, cancellation with 14 days’ notice<, or overbooking. It only applies to flights departing from the EU/EEA/UK, regardless of whether Air Canada is a non-EU carrier.
It is not due when the disruption is caused by exceptional circumstances (severe weather, ATC restrictions, instability for safety, etc.) and the company demonstrates that it has taken all reasonable measures to avoid it.
Anti-error keynote: for flights arriving in the EU/UK operated by Air Canada (non-EU/UK carrier) compensation does not apply; however, the protection of the Montreal Convention remains for proven damages (out-of-pocket expenses, etc.) and, when the departure is from the EU/UK, the rights of assistance.
You are entitled to compensation (EC 261/UK 261) if at least one of these cases occurs from the EU/EEA/UK:
Delay on arrival ≥ 3 hours compared to the scheduled time.
Cancellation communicated with less than 14 days notice and rerouting not equivalent (or refused).
Involuntary denied boarding (overbooking).
Compensation is not due when:
The event falls under extraordinary circumstances (p.es. extreme weather conditions, sudden closures of airspace, ATC restrictions, safety risks).
You accept a re-routing that arrives within the time thresholds that reset or reduce the compensation provided for by the legislation.
Assistance rights (when you are at the airport waiting): meals/drinks in relation to the delay, 2 communications (e.g. phone calls or emails), accommodation and transfer if necessary, rerouting or refund if the flight is cancelled or the delay becomes excessive.
The amounts of the flat-rate compensation (for departures from the EU/EEA/UK) depend on the distance of the route:
€250 for flights up to 1,500 km
€400 for intra-EU/EEA flights over 1,500 km and other flights between 1,500–3,500 km
€600 for flights over 3,500 km
For 3,500 km routes> with a delay of between 3 and 4 hours, the amount can be reduced by 50% (i.e. €300).
For flights departing from the UK, equivalent amounts in pounds sterling according to UK 261 apply.
Flight number and date (boarding pass or booking confirmation).
Full itinerary (all routes, including any replacement flight).
Proof of delay on arrival (photo board, email, company messages, etc.).
Receipts for expenses incurred while waiting (meals, hotels, transfers), also useful for the Montreal Convention.
Communications received from Air Canada about cancellation/rerouting.
Check eligibility (departure from EU/EEA/UK; delay ≥ 3h; cancellation <14 days; overbooking).

Refund if you do not travel and do not accept alternatives;
